Sean 'Diddy' Combs' attorneys have once again called for a mistrial in his high-profile case, accusing prosecutors of misconduct and presenting allegedly false testimony. The 55-year-old music mogul, who has pleaded not guilty to charges including racketeering and sex trafficking by force, faces renewed legal drama as his defense team challenges key evidence.
In a strongly worded letter obtained by People magazine and addressed to Judge Arun Subramanian on June 7, Combs' lawyers allege the prosecution knowingly presented misleading information about a controversial balcony incident from 2016. The defense claims this crucial piece of evidence - involving allegations that Combs dangled Bryana Bongolan from Cassie Ventura's apartment balcony - was fabricated.
"The government has presented testimony that it knew or should have known was materially false," the legal filing states. "To avoid an unfair conviction in this case the Court should grant a mistrial."
The defense team specifically targeted testimony from Combs' ex-girlfriend Cassie Ventura, arguing her account of witnessing the alleged balcony incident contradicts text messages they claim prove she only learned about it afterward. "The incident as alleged is disturbing and powerful evidence," the letter continues, "and the government has used it to depict Mr. Combs in an extremely negative light."
Adding fuel to their argument, Combs' attorneys challenge photographic evidence presented by prosecutors showing Bryana Bongolan's injuries allegedly sustained during the September 2016 incident. They maintain documentation proves their client was in New York City during those dates rather than Los Angeles where the photos were reportedly taken.
The filing further accuses prosecutors of improperly interfering with defense attempts to challenge what they call "perjured testimony" during cross-examination: "All of this was highly improper and exacerbated the harm caused by [...] the perjured testimony."
A Pattern of Controversy?
This marks Diddy's second attempt to have proceedings declared invalid after an earlier motion filed at May's end regarding questions about destroyed fingerprint evidence related to Kid Cudi's car bombing investigation. While Judge Subramanian denied that initial request - ruling those inquiries non-prejudicial - this new motion presents more detailed allegations challenging fundamental aspects of prosecutors' case.
